Democratic Party member Howard Lam will appear in Kowloon City court on Thursday morning, after he was deemed fit by doctors to make an appearance.
He is facing a charge of misleading police officers with claims that he was kidnapped and tortured by suspected mainland agents. Police had said on Wednesday that he would miss the hearing.
Lam was arrested on Tuesday, but moved to Queen Elizabeth Hospital on Wednesday after complaining of feeling unwell.
The 42-year-old is alleged to have misled a detective police constable knowingly by giving false information.
At a high-profile press conference last week where he was flanked by top party leaders, Lam claimed that a group of Mandarin-speaking men forced him into a vehicle in Mong Kok and tortured him. He said he was later dumped on a Sai Kung beach.
He also showed staples pinned into his thighs to back up his story.
